Patna High Court upheld the admission of more than 100 students who took admission in the first academic session of Radha Devi Jageshwari Memorial Medical College, Muzaffarpur in Bihar. A division bench of Chief Justice K Vinod Chandran and Justice Harish Kumar refused to interfere with the single bench’s decision dismissing all five appeals filed by the National Medical Council. While accepting the petition filed by the medical college, the single bench had declared the admission of more than a hundred medical students valid for admission in the first academic session of the session 2021-22.

It is noteworthy that after approving 150 MBBS seats, the Council’s Rating Board team had conducted a surprise inspection of the Medical College and its hospital on 26 and 27 November 2021. During inspection, patients were found in only 42 OPDs as compared to the desired 60 and shortage of teachers was found in many faculties of the college. On the basis of which the Council issued a letter to the State Government on 15 February 2022 and ordered that no one should take admission in this medical college.

The council was told by the state government and the medical college that after getting approval for 150 MBBS seats, admission of more than 100 students has been taken as per the rules. But rejecting the government’s reply, the council canceled the admission on 18 April 2022. The permission given to the college was withdrawn. The college challenged the council’s order in the High Court. The court declared the nomination correct.
